SMS Consent & Opt-In Disclosure

SendVyte provides automated SMS messaging services to healthcare practices. This page describes how patient consent is collected, what messages are sent, and how patients can opt out at any time.
1. How Patients Opt In to SMS Messages
Patient consent for SMS messaging is collected by the subscribing healthcare practice through their existing practice management software and patient intake workflows. SendVyte does not collect consent directly from patients. Consent is obtained through the following methods:
a) Practice Management Software (Primary Method)
Practices using TDO Software and other practice management systems collect SMS consent during patient registration and intake. The patient's SMS consent preference is recorded in the practice management system's database as a binary opt-in field (e.g., "Send SMS: Yes/No"). SendVyte reads this consent flag and only sends messages to patients who have opted in.
Key point: SendVyte will NOT send messages to any patient unless their SMS consent flag is set to "Yes" in the practice management system AND the patient is not on the practice's Do Not Contact (DNC) list.
b) Patient Intake Forms (Paper and Digital)
Practices collect SMS consent as part of their new patient paperwork. A typical consent statement on intake forms reads:
"I consent to receive appointment confirmations, reminders, and other practice communications via text message (SMS) at the mobile phone number provided. Message frequency varies. Message and data rates may apply. Reply STOP to cancel at any time. Reply HELP for help."
c) Verbal Consent
Front desk staff may obtain verbal consent from patients during scheduling or check-in, which is then recorded in the practice management system. Practices are trained to use the following script:
"May we send you appointment confirmations and reminders by text message? You can opt out at any time by replying STOP. Standard message and data rates may apply."
2. What Messages Are Sent
SendVyte sends the following types of SMS messages on behalf of subscribing healthcare practices:
- Appointment Confirmations: Sent the day before a scheduled appointment. Patients can reply "C" to confirm or "R" to request a reschedule.
- Appointment Reminders: Sent the morning of the appointment with the time and practice address.
- Google Review Requests: Sent after treatment completion, inviting the patient to leave a review. Sent a maximum of 2 times per treatment with a minimum 3-day gap between attempts.
- Manual Messages: Practice staff may send individual messages to patients for scheduling, follow-up, or other practice communications.
- Payment Requests: A link to pay an outstanding balance online.
Message Frequency
Message frequency varies based on appointment activity. Patients typically receive 2-4 messages per appointment (confirmation + reminder + optional review request). Practices are limited to their plan's monthly message allowance.

Standard message and data rates may apply depending on the patient's mobile carrier and plan.
3. How Patients Opt Out
Patients may opt out of SMS messages at any time using any of the following methods:
- Reply STOP: Text "STOP" to any message received from the practice's SendVyte number. The patient will receive a confirmation and no further messages will be sent.
- Reply HELP: Text "HELP" to receive information about the messaging program and opt-out instructions.
- Contact the Practice: Patients may contact their healthcare practice directly and request to be removed from SMS messaging. The practice will update the patient's SMS consent in their system.
Opt-out is immediate and permanent until the patient re-opts in. Once a patient replies STOP, SendVyte will not send any further messages to that phone number unless the patient initiates contact or re-opts in through the practice.

5. HIPAA Compliance
SendVyte is designed with HIPAA compliance in mind. Automated messages never include clinical diagnoses, treatment details, or other Protected Health Information (PHI). Messages are limited to scheduling information (date, time, practice name) and general practice communications. SendVyte enters into a Business Associate Agreement (BAA) with each subscribing practice.
